Licensing

The Licensing Act 2003 created a single integrated scheme for premises which are used for the supply of alcohol, the provision of regulated entertainment or late night refreshment. The scheme is now administered by the local authority responsible for the area where the premises are located. This replaced the old system where applications were made in the Magistrates Court

Premises Licences

A Premises Licence is required for establishments such as pubs, restaurants, nightclubs, licensed cafes and shops selling alcohol. A Club Premises Licence is required for Private Members’ Clubs

Personal Licences

Licensed premises must be managed by a Designated Premises Supervisor who is the holder of a Personal Licence. Personal Licences are also granted by the local authority and are issued to applicants in conjunction with the Police. To obtain a Personal Licence you must demonstrate to the local authority that you have a relevant licensing qualification. You must also undergo a criminal records check before a Personal Licence can be granted.

Temporary Events

The Licensing Act makes it possible to sell alcohol and/or have regulated entertainment at a temporary event such as in a marquee or at an outdoor music festival. A Temporary Event Notice is a simple and quick way of obtaining a temporary licence. It can be given by the organisers of the event providing it lasts only for a maximum of 96 hours. Only the police can object to a Temporary Event Notice on the grounds of law and order.
